By using the Taffy Dumpsters websites, you expressly accept and agree to abide by the terms and conditions contained in this Legal Statement. Do not use any of the Taffy Dumpsters websites if you do not accept and agree to these terms and conditions. 

1. Our Services

Taffy Dumpsters provides dumpster-rental and related waste-removal services in designated service areas. Available dumpster sizes, rental periods, pricing, delivery windows, pickup times, accepted materials, and service availability may vary by location and are subject to confirmation by us.

Information on the Site is provided for general informational purposes. A quote, online inquiry, estimate, or availability indication is not a binding offer or service guarantee unless and until we confirm your order.

We may refuse, cancel, or modify an order where necessary, including because of:

• Incorrect pricing or website errors

• Unavailable equipment, drivers, or delivery access

• Unsafe, unlawful, or unsuitable site conditions

• Customer nonpayment or failure to provide accurate information

• A request involving prohibited materials or activities

2. Quotes, Orders, and Pricing

Any price displayed or communicated by Taffy Dumpsters may be an estimate unless expressly stated otherwise in a written order confirmation, invoice, or rental agreement.

Your final charges may include applicable items such as:

• Overage charges based on weight limits

• Overage charges based on rental duration if you ask to keep a container for more nights

• Charges for prohibited materials, contamination, inaccessible loads, dry runs, relocation, additional trips, or damage

You are responsible for reviewing all quoted terms, including dumpster size, rental duration, included weight allowance, overage rate, delivery/pickup fees, and restrictions, before reserving your service rental.

We reserve the right to correct clerical, typographical, pricing, or listing errors, even after an order has been submitted. If a correction materially affects your order, we will make reasonable efforts to contact you before completing the affected service.

3. Payment and Deposits

Unless we agree otherwise in writing, payment is due according to the terms stated in your quote, invoice, order confirmation, or rental agreement. We may require a deposit, preauthorization, credit card on file, or payment in full before delivery.

By providing a payment method, you authorize Taffy Dumpsters to charge that method for authorized charges associated with your rental, including the quoted rental price and any applicable additional charges under these Terms or your rental agreement.

If a payment is declined, reversed, disputed, or not received when due, we may suspend service, delay delivery or pickup, seek collection of amounts owed, and recover reasonable costs of collection where permitted by law.

4. Delivery, Placement, and Pickup

You are responsible for providing a safe, accessible, lawful, and reasonably level location for delivery and pickup. Before delivery, you must identify the requested placement location and disclose relevant conditions, including narrow driveways, low-hanging wires or branches, gates, slopes, soft ground, underground utilities, weight restrictions, homeowner-association rules, and permit requirements.

We may decline, delay, or modify delivery or pickup if our driver determines that conditions are unsafe, inaccessible, likely to cause property damage, or otherwise unsuitable.

You are responsible for obtaining any required approvals or permits, including permits required to place a dumpster on a public street, sidewalk, right-of-way, or other restricted area. You are also responsible for complying with all local rules, property-owner requirements, and community restrictions.

Taffy Dumpsters is not responsible for damage resulting from ordinary access to or placement on a location selected or approved by you, including potential damage to driveways, curbs, sidewalks, lawns, landscaping, private roads, pavement, or underground features, except to the extent caused by our gross negligence or willful misconduct and as permitted by applicable law.

5. Customer Responsibilities

During the rental period, you are responsible for the dumpster and must use it safely, lawfully, and only for its intended purpose.

You agree to:

• Keep the dumpster secure and prevent unauthorized use

• Load materials evenly and safely

• Keep all materials at or below the top rim of the container

• Not move, tow, alter, paint, damage, or attempt to repair the dumpster

• Maintain reasonable access for scheduled delivery and pickup

• Notify us promptly if the dumpster is damaged, stolen, moved, blocked, or filled with prohibited materials

• Ensure that no person enters, climbs on, plays in, or otherwise uses the dumpster in an unsafe manner

• Pay for damage, loss, theft, cleaning, disposal, additional hauling, or other charges caused by your use, misuse, or failure to comply with these Terms

Do not overload the dumpster. Loads extending above the top rail, unsecured loads, or loads that cannot be safely transported may require you to remove material before pickup or may result in additional charges.

6. Prohibited Materials

You may not place hazardous, regulated, illegal, explosive, flammable, toxic, infectious, or otherwise prohibited materials in a dumpster. Examples may include:

• Tires, paints, solvents, chemicals, pesticides, and automotive fluids

• Gasoline, diesel, propane tanks, fuel containers, and other flammables

• Batteries, electronics, fluorescent bulbs, and mercury-containing items

• Asbestos or asbestos-containing material

• Medical, biological, pharmaceutical, or infectious waste

• Refrigerants, appliances containing refrigerants, and certain large appliances

• Drums, tanks, pressurized containers, and fireworks

• Radioactive materials

• Liquids of any kind

• Materials that are illegal to transport or dispose of through our service

Restrictions can vary by location, landfill, transfer station, and applicable law. If you are unsure whether a material is accepted, contact us before placing it in the dumpster.

If prohibited materials are found, you may be responsible for removal, special handling, cleanup, disposal, fines, penalties, additional transportation, administrative expenses, and any resulting damages or claims.

7. Rental Period and Extensions

Your rental period begins upon delivery unless otherwise stated in writing. You must make the dumpster available for pickup on or before the scheduled pickup date.

If you need additional time, contact us before the scheduled pickup date. Extensions are subject to availability and may result in additional daily, weekly, or other rental charges.

If the dumpster is inaccessible, overloaded, blocked, unsafe to collect, or otherwise unavailable at the scheduled pickup time, we may assess a trip charge, extended-rental charge, or other applicable fee and reschedule pickup.

8. Cancellations and Refunds

To cancel or reschedule an order, contact Taffy Dumpsters as soon as possible.

Cancellation, rescheduling, or refund eligibility may depend on when notice is received, whether dispatch or delivery has occurred, whether a dumpster has been reserved, and whether third-party costs have been incurred. Any deposit, cancellation, trip, delivery, or administrative fee will be handled according to the specific terms disclosed in your quote, order confirmation, invoice, or rental agreement.

Unless required by law or expressly agreed by us in writing, service fees incurred after a dumpster has been dispatched or delivered are nonrefundable.

9. Website Use

You may use the Site only for lawful, personal, or legitimate business purposes related to learning about or requesting Taffy Dumpsters’ services.

You may not:

• Use the Site in violation of applicable law or regulation

• Submit false, misleading, fraudulent, or unauthorized information

• Interfere with the Site’s security, operation, or accessibility

• Attempt to gain unauthorized access to systems, accounts, or data

• Use automated tools, bots, scraping, or data-mining tools without our written permission

• Copy, reproduce, distribute, modify, sell, or exploit Site content without authorization

• Use the Site to transmit malware, harmful code, spam, or unsolicited communications

We may restrict or terminate access to the Site at any time if we believe a user has violated these Terms or applicable law.

10. Intellectual Property

The Site and its content, including text, logos, branding, graphics, photographs, designs, service descriptions, layout, and functionality, are owned by or licensed to Taffy Dumpsters and are protected by applicable intellectual-property laws.

You may view and use the Site for lawful, noncommercial purposes connected with evaluating or requesting our services. You may not use our name, logo, branding, photographs, or other content without our prior written permission.

11. Third-Party Links

The Site may link to third-party websites, platforms, payment processors, maps, social-media services, or other resources. These links are provided for convenience only.

Taffy Dumpsters does not control, endorse, or assume responsibility for third-party content, policies, products, services, availability, or practices. Your use of a third-party website is governed by that third party’s terms and privacy policy.

12. Disclaimers

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. We do not guarantee that the Site will always be available, uninterrupted, secure, accurate, error-free, or free of harmful components.

We make reasonable efforts to provide accurate information, but dumpster sizes, availability, pricing, service areas, schedules, disposal rules, and other Site information may change. You should contact us to confirm details material to your order.

Except where prohibited by law, Taffy Dumpsters disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

13. Limitation of Liability

To the fullest extent permitted by law, Taffy Dumpsters and its owners, employees, contractors, agents, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of use, business interruption, or reputational harm arising out of or related to the Site, our services, or these Terms.

To the fullest extent permitted by law, our total liability for any claim arising from the Site or services will not exceed the amount you paid to Taffy Dumpsters for the specific service giving rise to the claim during the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Taffy Dumpsters and its owners, employees, contractors, agents, affiliates, and suppliers from claims, liabilities, losses, damages, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from:

• Your breach of these Terms

• Your misuse of the Site or dumpster

• Materials you place, cause to be placed, or allow to be placed in a dumpster

• Your violation of law, permit requirements, property restrictions, or third-party rights

• Your negligence, misconduct, or failure to provide safe and accessible service conditions

15. Privacy

Our collection and use of personal information are governed by our Privacy Policy, available at Privacy Policy. By using the Site or submitting information, you acknowledge that we may collect and use information as described in that policy.

16. Governing Law and Disputes

These Terms and any dispute arising from or related to the Site or our services will be governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Unless otherwise required by applicable law, any legal action related to these Terms must be brought exclusively in the state or federal courts located in Manistee County, Michigan, and you consent to the jurisdiction of those courts.

Before initiating a formal legal proceeding, the parties agree to make a good-faith effort to resolve the dispute informally by written notice.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Effective Date.” Your continued use of the Site or our services after updated Terms are posted constitutes acceptance of the updated Terms, to the extent permitted by law.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

These Terms, together with any applicable quote, order confirmation, invoice, rental agreement, and Privacy Policy, constitute the entire agreement between you and Taffy Dumpsters regarding the Site and relevant services, except where a separate written agreement expressly states otherwise.
